4. Payment Terms

Payment terms are specified in the individual service contract. Standard terms:

  • A deposit (typically 30-50%) is required before work begins
  • Progress payments may apply to larger or multi-phase projects
  • Final payment is due upon project completion and client walkthrough

Overdue balances may be subject to a late fee and may result in a lien being placed on the property in accordance with Oregon lien laws (ORS Chapter 87).

5. Project Timelines

Estimated dates are provided in good faith and are subject to change due to weather, material availability, client-requested changes, site conditions discovered during construction, or permit processing timelines. Delays caused by factors outside our control do not constitute a breach of contract.

6. Changes to Scope of Work

Any changes to the agreed scope of work must be approved in writing by both parties via a change order before work proceeds. Change orders may affect the total project cost and timeline.

7. Permits & Regulatory Compliance

Tierra Dura Construction LLC operates in compliance with Oregon CCB regulations (License #177429). Permit fees are the responsibility of the client unless explicitly included in the contract. Clients are responsible for HOA approvals required prior to project commencement.

8. Client Responsibilities

Clients agree to:

  • Remove personal property and vehicles from the work zone before the start date
  • Notify us of any underground utilities, irrigation systems, or buried lines
  • Be reasonably available to approve work as the project progresses
  • Make payments on time as outlined in the project contract

Workmanship warranty terms specific to your project will be detailed in your service contract. Warranties are voided by client modifications, misuse, neglect, or damage caused by third parties or natural events. Normal wear and weathering are not covered.

10. Limitation of Liability

To the fullest extent permitted by Oregon law, Tierra Dura Construction LLC's total liability for any claim shall not exceed the total amount paid by the client for the specific project giving rise to the claim. We are not liable for indirect, incidental, or consequential damages.

11. Photography & Portfolio Use
